Terms & Conditions

These Terms & Conditions govern your use of the Mods Support website (the “Website”). By accessing or using the Website, you agree to these Terms.

Entity: Mods Support – Tunisia (a subsidiary of Antares Infogérance)

1) Scope

These Terms apply to Website visitors and to the information made available on the Website. If you engage Mods Support for services, the relationship is governed by a separate written agreement between Mods Support and the client (the “Client Agreement”). In case of conflict, the Client Agreement prevails.

2) Definitions

  • “Mods Support”, “we”, “us”: Mods Support – Tunisia.
  • “Website”: the mods.tn / mods.support web properties and related pages.
  • “Client”: an entity that signs a Client Agreement with Mods Support.
  • “Client Agreement”: the contract governing services between Mods Support and a Client.
  • “SOW” (Statement of Work): a document signed between Mods Support and the Client describing scope, deliverables, SLAs, pricing, and operational details.
  • “DPA” (Data Processing Addendum): terms governing data processing under GDPR where applicable.

3) Website use

You may browse, view, and use the Website for lawful purposes. You agree not to misuse the Website, attempt to disrupt it, or access it using automated means in a way that degrades performance or interferes with other users.

4) 24/7/365 operations

Mods Support operates 24/7/365 across time zones. Specific coverage, staffing, response times, and SLAs (if any) are defined in the applicable SOW and/or Client Agreement.

5) Trial and commercial terms

Any commercial engagement (including pricing, billing, trial terms, and service levels) must be confirmed in writing in a Client Agreement and/or SOW.

  • Trial: a 30-day trial may be offered when a Client Agreement is signed, subject to the agreed scope.
  • Payment terms: Net 30, with an advance payment due at contract signature, as defined in the Client Agreement.
  • Late payments: Mods Support may allow up to 15 days of payment delay without interest. Continued non-payment may result in suspension or termination as defined below.

6) Acceptable use and prohibited content

Mods Support supports a wide range of online platforms. However, we do not accept engagements that involve the creation, distribution, promotion, or operational handling of illegal content or prohibited categories, including:

  • CSAM (child sexual abuse material) or any exploitation of minors
  • Violent content
  • Illegal drugs or trafficking
  • Self-harm related content
  • Weapons-related content

We reserve the right to refuse, suspend, or terminate access to services or communications where we reasonably believe the request involves prohibited content, illegal activity, or unacceptable risk.

7) Abusive behavior

We expect respectful communication. Abusive, threatening, or harassing behavior toward Mods Support staff may result in suspension of support communications and, for Clients, escalation under the Client Agreement (including possible suspension or termination of services).

8) Intellectual property

Website content (text, visuals, layout, branding) is owned by Mods Support or its licensors and is protected by applicable laws. You may not copy, reproduce, republish, or distribute Website content without prior written permission, except where permitted by law.

9) Privacy, GDPR, and subprocessors

We take data protection seriously. Our GDPR information is available on the GDPR page, and our third-party providers are listed on the Subprocessors List page.

Where applicable, processing of Client personal data is governed by the Client Agreement and a DPA. For subprocessors where a region can be selected (notably Zendesk and Microsoft Power BI), data may be hosted in the country or continent chosen by the Client, subject to vendor options and configuration.

10) Force majeure

Neither party is responsible for delays or failures caused by force majeure events as defined under international law, including (by way of example) major international internet outages, earthquakes and other natural disasters, or wars affecting the country.

11) Disclaimers

The Website is provided for informational purposes. While we aim for accuracy, we do not guarantee that all information is complete or current at all times. Nothing on the Website constitutes legal, financial, or regulatory advice.

For Clients, service outcomes depend on scope, configuration, and operational constraints defined in the SOW and Client Agreement.

12) Limitation of liability

Liability terms for services (including caps and exclusions) are defined in the Client Agreement. To the maximum extent permitted by law, Mods Support is not liable for indirect, incidental, or consequential damages arising from Website use.

13) Termination and handover (service engagements)

Any service engagement may be terminated:

  • With notice: 30 days written notice, as defined in the Client Agreement; or
  • For non-payment: if payment remains overdue for 30 days, subject to the agreed grace period and notice process.

Where applicable, a handover period will be provided to support transition, as defined in the Client Agreement/SOW (including operational handover, documentation, and agreed export/return processes).

14) Governing law

These Terms are governed by the laws of Tunisia. Any disputes relating to the Website shall be subject to the courts of Tunisia, unless otherwise agreed in a Client Agreement for service engagements.
